Michael Phelps Dominates US Nationals
IRVINE, Calif. — Michael Phelps won the 200-meter freestyle at the U.S. national championships, then came back less than an hour later to win the 200 butterfly on Wednesday night. Phelps led all the way in the 200 free and touched in 1 minute, 45.61 seconds – fastest in the world this year – to earn a spot on the U.S. team for the Pan Pacific championships later this month. “Still slower than I want to be,” the Olympic champion said. “I wanted to step on it in the first 100, then hopefully hold them off coming home.” Ryan Lochte finished second in 1:47.78, the second-quickest time in the world. It was a two-man race to the finish between the Olympic teammates. Peter Vanderkaay, the Olympic bronze medalist, was third in 1:46.84. Phelps was last off the blocks in the 200 fly, but he led all the way again and easily won despite what he called “probably the worst 200 fly I’ve swum in my life in terms of strokes and turns.” He touched in 1:56.00 – 4.49 seconds slower than his world-record time at last year’s world championships in Rome. “I didn’t feel good at all,” he said.

Michael Phelps returned to action over the weekend, competing at the Charlotte UltraSwim in North Carolina. The 14-time gold medalist won three of four races, but narrowly lost the 100-meter backstroke to local trainee Nicholas Thoman. The Olympic superstar did not sound particularly enthusiastic after the competition, describing his weekend as “not great, not terrible.” He also admitted that he has room to improve. “I’ll be the first to admit my training isn’t where it should be,” he said. Prop 8 OVERTURNED: Gay Marriage Ban Struck Down In California
In a major victory for gay rights activists, a federal judge ruled on Wednesday that a voter initiative banning same-sex marriage in California violated the Constitution’s equal protection and due process rights clauses. After a five-month wait, 9th Circuit District Court Judge Vaughn Walker offered a 136-page decision in the case of Perry v. Schwarzenegger, firmly rejecting Proposition 8, which was passed by voters in November 2008. “Although Proposition 8 fails to possess even a rational basis, the evidence presented at trial shows that gays and lesbians are the type of minority strict scrutiny was designed to protect,” Walker ruled. “Plaintiffs do not seek recognition of a new right. To characterize plaintiffs’ objective as “the right to same-sex marriage” would suggest that plaintiffs seek something different from what opposite-sex couples across the state enjoy — namely, marriage. Rather, plaintiffs ask California to recognize their relationships for what they are: marriages.” “Proposition 8 places the force of law behind stigmas against gays and lesbians, including: gays and lesbians do not have intimate relationships similar to heterosexual couples; gays and lesbians are not as good as heterosexuals; and gay and lesbian relationships do not deserve the full recognition of society.” The judgment was the first offered by a federal court with respect to laws banning gay marriage at the state level and it promises to have massive reverberations across the political and judicial landscape. The decision is now expected to head to the Ninth Circuit Appeals Court (also based in San Francisco) for appeal and from there to the Supreme Court. In the interim, however, Walker’s ruling gave gay-rights activists a second occasion to rejoice in less than a month. In July, a federal judge in Massachusetts ruled that the federal Defense of Marriage Act (DOMA), which defines marriage as one man and one woman, was also unconstitutional. “It is not only a home run it is a grand slam,” said Jon Davidson the legal director at Lambda Legal, the country’s largest and oldest LBGT legal organization.

SAN FRANCISCO — A federal judge has reached a decision in a landmark case on whether California’s same-sex marriage ban violates the constitutional rights of gay men and lesbians. Chief U.S. District Judge Vaughn Walker will issue his ruling Wednesday afternoon, court spokeswoman Lynn Fuller said. His verdict comes in a lawsuit brought by two same-sex couples and the city of San Francisco seeking to overturn California’s voter-approved Proposition 8, which outlawed gay marriage five months after the state Supreme Court legalized it. Both sides previously said an appeal was certain if Walker did not rule in their favor. The case would go first to the 9th U.S. Circuit Court of Appeals then the Supreme Court if the high court justices agree to review it. Anticipating such a scenario, lawyers for the coalition of religious and conservative groups that sponsored Proposition 8 in 2008 filed a legal brief Tuesday asking Walker to stay his decision if he overturns the ban so same-sex couples could not marry while an appeal was pending. “Same-sex marriages would be licensed under a cloud of uncertainty, and should proponents succeed on appeal, any such marriages would be invalid,” they wrote. Walker presided over a 13-day trial earlier this year that was the first in federal court to examine if states can prohibit gays from getting married without unlawfully infringing on their civil rights. Supporters argued the ban was necessary to safeguard the traditional understanding of marriage and to encourage responsible childbearing. Opponents said that tradition or fears of harm to heterosexual unions were legally insufficient grounds to discriminate against gay couples..

California’s Proposition 23 is shaping up to be a big fight. The proposition would suspend California’s Assembly Ballot 32 (AB 32), otherwise known as the Global Warming Solutions Act, which was signed by Gov. Schwarzenegger in 2006. AB 32 requires greenhouse gas emissions to be reduced to 1990 levels by 2020. But there’s a movement brewing that argues that the Global Warming Solutions Act would cost the state over 1 million jobs and result in hundreds of billions of dollars in productivity loss if its progressive climate change measures are enacted. The California Jobs Initiative, which is leading the effort to suspend the climate change legislation, has raised over $3.1 million to suspend the Global Warming Act.
